High Court Urges Prosecution to Trim Witness List in Albert Ojwang Murder Case

The High Court has instructed prosecutors in the Albert Ojwang murder trial to further reduce the number of witnesses they intend to call, citing concerns that an overly long list could unnecessarily prolong proceedings.

Justice Diana Kavedza issued the directive on Monday during a pre-trial mention at Kibera High Court. The move comes after the Independent Policing Oversight Authority (IPOA), leading the prosecution, indicated plans to rely on 28 witnesses to establish the case.

The judge emphasized the importance of quality over quantity, noting that with six defence lawyers involved, lengthy cross-examinations could extend the trial for years if all witnesses are heard. She suggested a maximum of three witnesses per day under current courtroom arrangements, warning that the full list could stretch the case to nearly two years.

“Credibility of evidence is more important than the volume,” Justice Kavedza said, stressing that criminal liability does not require dozens of witnesses.

She directed the investigating officer to collaborate with IPOA to refine the prosecution file, ensuring only essential witnesses whose testimony is critical to proving the charges are retained.
