Court Suspends Kiambu County’s Medical Specialists Recruitment Over Alleged Irregularities

The Employment and Labour Relations Court in Nairobi has issued temporary orders stopping the Kiambu County Government from proceeding with its ongoing recruitment of medical specialists, following a petition challenging the fairness of the process.

Justice Hellen Wasilwa ruled that the matter, which raises serious legal and constitutional questions, be treated as urgent and scheduled for an inter partes hearing on October 28, 2025.

In her directive, Justice Wasilwa stated, “The application is certified urgent and allowed in terms of the prayers of the Notice of Motion. This application should be served upon the respondents and be heard inter partes on the 28th October 2025.”

The ruling effectively pauses all recruitment activities within the Department of Health Services in Kiambu County until the court determines whether the process adhered to the law.

The case was filed by Dr. Gathoni Njeri Muriithi, an obstetrician and gynecologist, who has sued both the County Government of Kiambu and the County Public Service Board.

Through her lawyer, Henry Kurauka, Dr. Muriithi contends that the recruitment was marred by irregularities and violated her constitutional rights. She claims the process lacked transparency and fairness, alleging that shortlisting and interviews were conducted even before the official application deadline of October 15, 2025 had lapsed.

In her petition, she argues that such actions contravene the principles of equality, fairness, and transparency enshrined in the Constitution and the County Governments Act, and that the integrity of the hiring process must be upheld.
