The Judiciary has reaffirmed its commitment to impartiality and due process in the ongoing Ksh.1.2 billion loan dispute between former Cabinet Minister Raphael Tuju and the East African Development Bank (EADB). The case, which involves Tuju’s company, Dari Limited, and a prime 27-acre property in Karen, has sparked legal debates and public interest.

In response to growing scrutiny, Judiciary Spokesperson Paul Ndemo issued a statement underscoring the importance of judicial independence and the sub judice rule, which restricts public discussions on active cases to prevent external influence.

“We urge all parties to refrain from litigating their cases through the media or social media platforms. We also call on the media to verify facts before reporting on such matters to avoid contributing to misinformation or disinformation,” Ndemo stated

Tuju has publicly through a local broadcaster Spice FM alleged bias by Supreme Court judges handling the case, raising concerns over fairness in high-profile financial disputes. However, EADB maintains that it adheres to strict governance and due diligence processes in all its operations across member states.

With the dispute still before the courts, the Judiciary has made it clear that the legal process must proceed without external interference, reinforcing the importance of allowing the law to take its course.
