Former Kiambu Governor Ferdinand Waititu has taken a new step in his legal battle after the High Court granted him permission to amend his earlier bond application, giving him another chance to seek release from prison.

Waititu, who is currently serving a 12-year sentence or a fine of Sh53 million for corruption, filed a fresh request through his lawyers, asking the court to allow amendments to his previously dismissed bond application.

Justice Lucy Njuguna, presiding over the Anti-Corruption and Economic Crimes Division, ruled in his favour on Wednesday.

“After considering the submissions from both sides, I found that a petition of appeal may be amended with the leave of the court. The application has merit and is therefore granted,” she stated.

Waititu has been behind bars since February, following his sentencing by a magistrate’s court. His initial attempt to secure bond was rejected in early March, but his legal team led by advocates Kibe Mungai and Ndegwa Njiru sought leave to modify their earlier application.

Although the move was opposed by the Director of Public Prosecutions, the judge allowed the amendment, offering Waititu a fresh chance to argue for his release while his appeal is pending.
